Testify?

Karl Rove, President Bush's longtime political guru, refused to obey an order to testify before a House Judiciary Committee hearing Thursday. Rove's lawyer asserted that Rove was "immune" from the subpoena the committee had issued, arguing that the committee could not compel him to testify due to "executive privilege."

..."executive privilege"? That's what keeps him immune from testifying?? I'm confused. Didn't Sadaam 'executive privileges' too? No worries. He and Rove will have plenty of time to hash all of that out in hell.

Just as a legal technicality... you have to be convicted of a crime before you can be pardoned... So your third option is just not possible.
